The Local Answer Competition Terms & Conditions

These Terms and Conditions are made by The Local Answer Limited, a company registered in England and Wales with Company Number 06929408 and registered office at Unit H Churchill Industrial Estate, Churchill Road, Leckhampton, Cheltenham GL53 7EG. ("Promoter").

1. By entering any The Local Answer promotion (competition, giveaway, prize draw, offer or discount) entrants confirm that they have read and agreed to these terms and conditions and by the decisions of The Local Answer (the Promoter), which are final in all matters relating to the prize. Failure to do so will result in the forfeiture of the prize. No correspondence will be entered into.

2. The Local Answer Competitions are available to all residents of the United Kingdom aged 18 and over at the time of entry, except as set out in Clause 4.

3. The Supplier: Please see each individual promotion for details of the prize supplier.

4. Employees of the Promoter, their immediate family members, or any other persons professionally connected with the Competition, are not eligible to enter the Competition.

7. Entry instructions: Please see the individual prize promotion for the entry details.

8. Only one entry per person per promotion add on each platform unless otherwise stated. All additional entries will be disqualified.

9. Any entries that the Promoter considers (in our absolute discretion) to be fraudulent, offensive, indecent, illegal, racist, copied, cruel or infringe on the rights or copyright of others will be immediately disqualified.

10. The Promoter will not accept Competition entries that are automatically generated by computer, completed by third parties or in bulk, illegible, have been altered, reconstructed, forged or tampered with, or are incomplete. Participants deemed to be using multiple email accounts will be disqualified.

11. Incomplete, illegible, misdirected or late entries will not be accepted. Proof of sending an entry is not proof of receipt by the Promoter. The Promoter is not responsible for entries lost, delayed, or not received for any reason.

12. Winner Selection: Prize draw winner (s)will be randomly selected from all correct entries by a random generator built into The Local Answer’s website. Skills based entries shall be judged based on the judging criteria, set out in the promotion, by a panel which shall include one judge independent to the Promoter.

13. Winner Notification: The winners will be notified by email via the account provided and will have 48 hours from notification to claim their prize. If a winner does not claim their prize within this timeframe the promoter reserves the right to withdraw prize entitlement and will award the prize to the next randomly generated winner.

14. It is the responsibility of the entrant to provide correct, up-to-date details when entering the prize promotion and acceptance of the prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

15. General: The Promoter’s decision is final and binding. No correspondence will be entered into. Entry implies acceptance of these terms and conditions.

16. The Prize must be accepted as awarded and is non-transferable, non-exchangeable, and not redeemable for cash or other forms of compensation, unless otherwise specified by the Promoter.

17. In the event that the Prize, or any part of the Prize, becomes unavailable for any reason beyond the control of the Promoter, the Promoter reserves the right to substitute a prize of equal or greater value.

18. The Promoter reserves the right to verify winners and ask for proof of identity, age and address and to withdraw prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions.

19. By entering the Competition, the Participant grants the Promoter, and any of its affiliates, the right to use their name, likeness, image, voice, and any other Personal Data submitted with their entry for promotional purposes related to the Competition, without any further compensation, notice, review, or consent, unless prohibited by law.

20. The name of the winners will be published on The Local Answer’s website within 28 days of the closing date

21. The Promoter reserves the right, at its sole discretion, to eliminate or disqualify any entries or entrants that it regards as being in breach of these terms and conditions or the spirit of the Promotion. Those who try to circumvent the entry process and/or entry instructions by any method, will be disqualified and any prize award will be void.

22. The Promoter will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with the Competition or accepting or using the Prize, except for any liability which cannot be excluded by law (including personal injury, death and fraud) in which case that liability is limited to the minimum allowable by law. The Promoter shall not be liable for any losses to the winner or any other person resulting from use of the prize, and it does not provide any form of insurance, including without limitation any public liability or cancellation insurance, for any prize in relation to the Competition.

23. If for any reason, the Promotion is not capable of running as planned for reasons (including but not limited to tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion), the Promoter reserves the right (subject to any written directions given under applicable law) to disqualify any individual who tampers with the entry process and to cancel, terminate, modify or suspend the Promotion.

24. The Promoter shall not be liable to the Participant as a result of any delay or failure to perform its obligations under these Terms and Conditions as a result of a Force Majeure Event (any event beyond the reasonable control of the Promoter including but not limited to strikes, lock-outs or other industrial disputes, failure of a utility service or transport network, act of God, war, riot, civil commotion, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery, fire, flood, storm or default of suppliers or subcontractors).

25. The Promoter is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any email or entry to be received by the Promoter on account of technical problems or traffic congestion on the Internet, telephone lines or at any website, or any combination thereof, including any injury or damage to Participant's or any other person's computer or mobile telephone related to or resulting from participation in the Competition.

26. Where a prize is provided by a Supplier, the Promoter accepts no responsibility for inaccuracy of any prize description, and The Supplier is responsible for prize fulfilment.

27. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.

28. The Promoter reserves the right to terminate the Competition at any time if circumstances beyond the Promoter's reasonable control make it necessary to do so. Such circumstances may include, but are not limited to, instances of fraud, technical difficulties, or if the minimum number of entries is not met. In the event of termination, the Promoter will provide notice to the Participants as soon as reasonably practicable. The notice will be given via the same method used to communicate the Competition, or any other method the Promoter deems appropriate. Upon termination, the Promoter may, at its sole discretion, decide to provide an alternative prize of equivalent value. The Promoter's decision in this regard will be final and binding.

29. The decisions of the Promoter are final and binding in all matters relating to the Promotion and no correspondence will be entered into.

30. The Promotion and these terms and conditions, and any disputes arising therefrom, shall be subject to English law and the exclusive jurisdiction of the English and Welsh Courts.

31. Data Protection: Any personal information that entrants share with the Promoter will be kept secure and only used in line with these terms and conditions unless the entrant has opted in to future marketing from the Promoter and/or the Supplier. By entering the promotion, entrants agree that their information may be used by the Promoter to administer the promotion, and winners consent to give their name for the winners’ list. Only winners’ details will be passed on to the Supplier for the purpose of delivery of the prize.

32. By entering any The Local Answer Competition, you agree to receive a one-off promotional email from The Local Answer on behalf of the prize Supplier once the Competition has ended. Participant details will not be passed on to the Supplier or any other third party.

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the terms and conditions and by participating all claimants will be deemed to have accepted and be bound by the terms and conditions. Please retain a copy for your information.
